Terms & Conditions

By downloading, installing, or using the SoberDown mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.

You must be at least 18 years old to use SoberDown. By using the App, you represent that you are at least 18 years of age. If we discover that a user is under 18, we will terminate their account immediately.

SoberDown is available to users in the United States. Use from other jurisdictions is at your own risk and subject to local laws.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and truthful information when creating your account
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized use of your account
• Not create multiple accounts or impersonate other users

You may delete your account at any time in Settings → Account → Delete Account. Account deletion is permanent and will remove all your data within 30 days.

The Code Red feature sends SMS messages to personal contacts you designate. When you add a contact, they receive a one-time opt-in notification SMS explaining the program and giving them the ability to opt out permanently by replying STOP before any crisis alert is ever sent. By using Code Red you acknowledge:

• Contacts receive an opt-in notification SMS when first added and may opt out at any time by replying STOP
• SoberDown will not send Code Red alerts to any contact who has opted out
• SoberDown is not responsible for whether your contacts respond or are available
• SMS delivery depends on third-party carriers and is not guaranteed
• Message and data rates may apply to all SMS messages sent through SoberDown
• Code Red is a supplement to — not a replacement for — professional mental health care
• Misuse of Code Red (false alerts, harassment) may result in account termination

By adding someone as a Code Red contact, you represent that you personally know this individual and that you have a reasonable basis to believe they are willing to receive emergency support requests from you.

SoberDown provides both official communities and user-created private groups. By participating in communities you agree to:

• Treat all members with respect and compassion
• Not share another member's personal information outside the community
• Not record, screenshot, or distribute community content without consent
• Not use community spaces for commercial solicitation or spam

Private groups are visible only to the group owner and invited members. As a group owner you are responsible for the conduct of your group and ensuring invited members have consented to join.

SoberDown reserves the right to remove content or suspend access to communities that violate these Terms.

You agree not to use SoberDown to:

• Harass, threaten, or harm other users
• Post content that is hateful, discriminatory, or abusive
• Impersonate other users or SoberDown staff
• Share illegal content or encourage illegal activity
• Attempt to gain unauthorized access to other accounts or our systems
• Use the app for commercial advertising without permission
• Share content that exploits or endangers minors
• Deliberately trigger false Code Red alerts

Violations may result in immediate account suspension or termination without notice.

You retain ownership of content you post on SoberDown. By posting content, you grant SoberDown a non-exclusive, royalty-free license to display and distribute that content within the app for the purpose of providing the service.

You represent that you have the right to post any content you share, and that it does not infringe on the rights of others.

SoberDown is not responsible for user-generated content and does not endorse the views expressed by users.

Apparel and merchandise purchases through the SoberDown shop are processed via Shopify and fulfilled by Printful. By making a purchase you agree to Shopify's and Printful's terms of service in addition to these Terms.

• All sales are final unless the product is defective or incorrect
• Shipping times are estimates and not guaranteed
• SoberDown is not responsible for carrier delays

SoberDown is provided "as is" without warranties of any kind. We do not warrant that:

• The app will be available at all times or error-free
• Code Red alerts will be delivered or responded to
• Community content is accurate, complete, or safe to follow
• The app is a substitute for professional mental health treatment

SoberDown is a peer support community platform. Nothing in the app constitutes medical, psychological, or therapeutic advice. Always seek professional help for mental health concerns.

To the fullest extent permitted by law, SoberDown and its owners, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to:

• Failure of Code Red alerts to be delivered or responded to
• Harm resulting from reliance on community content
• Unauthorized access to your account
• Any interruption or cessation of the service

Our total liability to you for any claim shall not exceed the amount you paid to SoberDown in the twelve months preceding the claim.

You may terminate your account at any time by deleting it in the app. We may suspend or terminate your account at any time for violation of these Terms, with or without notice.

Upon termination, your right to use the app ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including disclaimers and limitations of liability.

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.
